IPercept Technology AB, reg. no. 559208-4882, (“IPercept”, “we”, “us”) recognises the importance of protecting the privacy of your personal data. The purpose of this privacy policy (the “Policy”) is to inform of how we process your personal data in connection with the provision of our services (the “Service”) and otherwise when you interact with us.

Terms used in this Policy shall have the same meaning as in Regulation (EU) 2016/679 (the “GDPR”).

WHO IS RESPONSIBLE FOR THE PROCESSING OF YOUR PERSONAL DATA?

We are the data controller in relation to the personal data processing described in this Policy. It is therefore our responsibility to ensure that the processing of personal data for which we are the data controller takes place in accordance with applicable data protection legislation.

CATEGORIES OF PERSONAL DATA

Within the framework of the provision of the Service, we process the following categories of personal data:

  • First and last name,
  • Address,
  • Telephone number,
  • E-mail address,
  • IP-address,
  • Password,
  • User activity data (e.g., which user accessed which page and when), and
  • Company/Employment information (title, position or similar).

Although some of the aforementioned data on a stand-alone basis cannot identify a person, the data may, combined with other data, indirectly identify a person and thereby constitute personal data.

We may also process other categories of personal data, for example in connection with support cases. The specific personal data that we process is dependent on the information you choose to share with us.

PURPOSES OF THE PROCESSING OF PERSONAL DATA

We process personal data for the following purposes:

To provide the Service

We process personal data to provide the Service to our customer companies, e.g. to administer user accounts to representatives of our customer company, provide functionality in our web application, etc. The personal data processed for this purpose is collected from our users.  

The personal data processed for the aforementioned purpose includes name, address, phone number, email, IP-address, user activity and professional role.

The legal basis for the processing of personal data for the aforementioned purpose is the contract between us and the customer. The processing of personal data that takes place for this purpose is necessary for us to be able to fulfil the agreements we enter into with our customers aimed at providing the Service.

We store the personal data listed above for the duration of your use of the Service or until the termination of your user account. However, we may store the personal data for a longer period of time if this is necessary for us to be able to defend ourselves against any legal claims from customers, users or third parties.

To manage invoices etc.

Where applicable, we process personal data for the purpose of managing invoices and receipts. The personal data processed for this purpose is name and email. The personal data processed for this purpose is collected from our customers.

The legal basis for the processing of personal data for the purpose of managing invoices is the agreement between us and our customers, e.g. for processing payments within the Service. The processing of personal data that takes place for this purpose is necessary for us to be able to fulfil the agreements we enter into with our customers aimed at providing the Service.

The personal data listed above is stored for a period of seven (7) years from the time it is received. The legal basis for this storage is a legal obligation. However, we may store the personal data for a longer period of time if necessary for us to be able to defend ourselves against any legal claims from customers, users or others.

To develop and improve the Service

We process personal data for the purpose of developing and improving the Service in connection with your use of the Service or otherwise interacting with us. The personal data processed for this purpose is name, email, phone number and professional role.

The legal basis for the processing of personal data for the purpose set out above is our legitimate interest in developing and improving the Service.

The personal data processed for this purpose is collected directly from the person who uses the Service. We store the personal data during the time under which you have an active user account.

To provide support

We process personal data for the purpose of providing support to our customers and others. This can be done by contacting us, or by us contacting you. The type of personal data processed for this purpose depends on the specifics of each case, as well as the personal data you choose to share with us. The legal basis for the processing of personal data for the purpose set out above is our legitimate interest in providing support linked to the Service.

The personal data processed for this purpose is collected directly from the data subject. We process personal data for this purpose for such a period as is necessary to handle the case in question, however, we strive to delete the personal data when the case is closed.

To troubleshoot the Service

We process personal data to troubleshoot the Service. The personal data processed for this purpose is IP-address, name, email, phone number and professional role.

The legal basis for the processing of personal data for the purpose set out above is our legitimate interest in preventing and remedying errors in the Service, as well as making the use of the Service as error-free as possible.

The personal data is generally collected from the user. We process personal data for this purpose as long as you have an active user account.

For marketing and communication

We process personal data to market the Service, products or ourselves through newsletters. The personal data processed for this purpose are name, email, phone number and professional role and other categories of personal data which you have provided to us.

The legal basis for the processing of personal data for the purpose set out above is our legitimate interest in marketing the Service. In the event that you have actively subscribed to receive notifications related to the Service by e-mail or SMS, the legal basis for the processing is your consent. You have the option to unsubscribe from our mailings directly via the email you receive from us and the right to withdraw your consent at any time with effect for the future. If consent is withdrawn, we will promptly cease the processing of your personal data for this purpose. Otherwise, feel free to contact us and we will help you with the deregistration.

The personal data is generally collected from you. We store the personal data processed for the purpose of sending out newsletters and conducting other communications with you as long as you have a registered account.

TRANSFER OF PERSONAL DATA

We may transfer personal data to third parties within the EU/EEA. When we share personal data with third parties they act in the capacity of a personal data processor on our behalf. The provider processes personal data on our behalf and in accordance with our instructions. We have special agreements in place with our data processors in order to ensure that their processing of personal data takes place in accordance with our instructions and applicable data protection legislation.  

We currently share personal data with the following categories of recipients:

  • Cloud infrastructure providers in the IT services sector, for secure storage of personal data in dedicated and encrypted databases (e.g., located within the EU/EEA);
  • Accounting and invoicing software providers in the financial software sector, used to manage our billing and financial records;
  • Customer relationship management (CRM) providers in the enterprise software sector, used to manage client and prospect interactions.

All such third parties are located within the EU/EEA and are contractually bound to ensure compliance with applicable data protection regulations. A complete list of specific recipients is available upon request, in accordance with your rights under data protection law.

We may also disclose personal data to authorities or other public actors in the event that such disclosure is required by law.

SAFETY

We have taken technical and organisational measures in respect of the personal data processed in accordance with this Policy. Where necessary, we will, among other things, encrypt, anonymise and limit access to personal data to ensure that your personal data is sufficiently protected.

We also take technical and organisational measures to prevent intentional or unlawful destruction, loss, alteration, unauthorised disclosure of or unauthorised access to personal data transmitted, stored or otherwise processed.

SHELF LIFE

Notwithstanding the above, we will always endeavour to process personal data only for as long as it is necessary to fulfil the purpose for which it is processed. We do not store personal data for any longer than permitted by applicable data protection legislation, including the GDPR.

YOUR RIGHTS

You have a number of rights under the GDPR. These rights essentially mean that you should be informed about when and how your personal data is processed and that you should have control over your personal data.

Right of access

You have the right to obtain confirmation as to whether or not personal data concerning you are being processed and, if so, access to such personal data and information concerning, inter alia, the purposes of the processing, the categories of personal data concerned and the categories of recipients to whom your data have been or will be disclosed.

We do not process personal data for automated decision-making.

Right of rectification

You have the right to request that inaccurate personal data relating to you be corrected and that incomplete data be completed.

Right of erasure

In certain circumstances, you have the right to request that we delete or restrict the processing of your personal data. Such circumstances include:

  • if the personal data is no longer necessary for the purpose for which it was collected;
  • if the processing is made for the purpose of direct marketing and you object to such processing;
  • if you object to the processing of personal data on the legal basis of balancing of interests and there are no compelling legitimate grounds overriding your interests; and
  • if the processing of personal data is not in compliance with applicable law.
Right of objection

If we are processing your personal data on the legal basis of balancing of interests, you have the right to request that the processing be stopped. Unless we can demonstrate compelling legitimate grounds for the processing which override your interest in not having your personal data processed, we will stop the processing.

Right to data portability

Where our processing is necessary for the performance of a contract, you have the right to request that the data which you have provided to us shall be provided to you in a structured, commonly used and machine-readable format.

Please note that some rights are limited by law. This means that in certain circumstances we are not obliged to comply with a request to exercise a certain right.

CHANGES TO THE POLICY

We reserve the right to make changes to this Policy from time to time. The date of the last change is shown below. Any changes to the Policy will be published on our website and/or in our newsletter. We recommend that you keep up to date with the contents of the Policy to keep track of any changes to the Policy.

If we change the Policy in a way that represents a material change, we will notify interested parties and, where appropriate, require such parties to read and re-accept the Policy
